Move Greener ltd will not be liable for any damages or injury
caused by, including but not limited to, any failure of performance, error, omission,
interruption, defect, delay in operation of transmission, computer virus, or line
failure. Move Greener ltd will not be liable for any damages or injury, including
but not limited to, special or consequential damages that result from the use of,
or the inability to use, the materials in this web site, even if there is negligence
or Move Greener ltd or an authorised Move Greener ltd representative has been advised
of the possibility of such damages, or both. The above limitation or exclusion may
not apply to you to the extent that applicable law may not allow the limitation
or exclusion of liability for incidental or consequential damages. Move Greener
ltd total liability to you for all losses, damages, and causes of action (in contract,
tort including without limitation, negligence), or otherwise will not be greater
than the amount you paid to access this web site.
9. Refunds
You may cancel this contract by informing Move Greener ltd in writing or email within
24 hours of placing the advert.
No refund will be made after 24 hours or after you have received an enquiry in your
account, whichever is first. All advertising after 24 hours is classed as ‘Free
of Charge’.
Under no circumstances will our liability exceed the value of advertising fee received
This does not affect your statutory rights as a consumer.
10. The Move Greener ltd reserves the right to alter and add to the above terms and conditions at any time, and will be under no obligation to positively inform the user of these changes. The changes will be posted on the website as soon as is practically possible and it is the responsibility of the user to verify their continued acceptance.
11. Only one property or room may be advertised per paid listing, if it is found that more than one property or room has or is being advertised within one single paid listing the advert will be removed without notice and no refund will be given.
Payment Terms
All Energy Performance Certificates and Home Information Pack remain the property of Move Greener ltd until full payment has been received.
Adverts placed will automatically be removed after 365 days to stop a build up of inactive ads.
Once payment has been received the HIP and/or EPC become the property of the payee to use for the marketing and/or sale of the property privately or through any other means.
The Energy Performance Certificate and/or Home Information Pack will be charged on the rates stated on our prices page for the amount of bedrooms stipulated on the instruction to Move Greener ltd.
If the property is (within a 12 month period and having had no extensions, loft conversions or rooms added) advertised for sale or rent with the sale or rent advertising stating more bedrooms than was stated on the Energy Performance Certificate and/or Home Information Pack instruction to Move greener ltd, Move Greener ltd reserve the right to charge £30+vat for each additional bedroom not disclosed to us on the instruction. For example but not limited to your instruction to Move Greener ltd to carry out an Energy Performance Certificate and/or Home Information Pack stating 3 bedrooms and a study and therefore charged at the 3 bedroom rate but your sale or rental advertising states 4 bedrooms where the 4th bedroom was stated to Move Greener ltd as being a study. The same principle applies to the stated property value at time of instruction to Move Greener ltd to carry out the Home Information Pack and/or Energy Performance Certificate, if it is stated to us that the property value is less than £395,000.00 but the property is then advertised (within a period of 30 days) for £395,00.00 or higher Move Greener ltd reserve the right to charge the additional amount outstanding relating to percentage of property value depending on service provided EPC or HIP. The additional amount charged will be liable for payment within 7 days from the date of the invoice. If, despite reminders you have still not paid any amount outstanding after 60 days, then Move Greener ltd reserves the right to add a charge of £400 to the outstanding amount to cover debt collection administration.
Electronically delivered copies of the EPC and/or HIP will be charged at £5.00 +VAT, delivered after payment has been received.
Paper copies of the EPC and/or HIP will be charged at £10.00 + VAT, posted after payment has been received. Prices are subject to change in the future and will be shown here.
Discounted prices can be arranged for multiple instructions.
Once instructed and a time and date has been agreed by both parties full payment will be charged if no access can be gained to the property to be assessed at the time and date agreed or access is not possible due to circumstances beyond the control of Move Greener ltd. Circumstances may include but not limited to unaccompanied children at the property, unaccompanied and/or dangerous animals at the property, unaccompanied ill or bed bound elderly or minors at the property. These terms are subject to change and it is the responsibility or the party instructing Move Greener ltd to make themselves aware of current terms prior to instruction.
